TERMS & CONDITIONS

By entering the Promotion, entrants will be deemed to be bound by and have accepted these Terms and Conditions. These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.

General

1. The Promotion is open to UK (excluding NI) residents aged 18 or over, excluding employees and their immediate families of the Promoter and its associated, affiliated or subsidiary companies, its agents and anyone else professionally connected with the Promotion.
2. This Promotion is not open to residents of Northern Ireland.
3. The Promotion opens on 20.06.2024 at 00:00 BST and closes at 23:59 BST on 17.07.2024 (subject to availability whilst stocks last in participating stores). Entries outside of this period will not be accepted.
4. Mobile phone required.
5. Purchase required. Retain receipt for proof of purchase.

How to enter

6. Purchase Belorante Primitivo or Belorante Pecorino (the “Product”) at a participating ASDA store or at www.asda.com. Each store’s stocking of the Product is subject to availability and whilst stocks last.
7. Following purchase text BELORANTE to 60163.
8. Entrants submitting a valid text entry will receive a text message confirming their entry. Time taken to receive this text message may vary. A text entry will be charged at your standard network rate (and may not be included within any free text packages). Please check with the bill payer before sending a text entry. Entrants are advised to take care when submitting an entry; the Promoter is not responsible for mistypes and incorrect texts may still be charged. Only correctly submitted entries will be accepted. For the avoidance of doubt entries featuring spelling mistakes will be disqualified. Capital or lowercase letters will both be accepted. Entries received after the closing date will not be entered but may still be charged.
9. A maximum of one entry can be submitted per person per day.
10. Invalid, misdirected or late entries will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.
11. Bulk entries, entries submitted via agents, third parties, organised groups or those automatically generated by computer will not be accepted but may still be charged. Entries received by any other means (e.g. post) will be rejected. Any person persistently trying to circumvent the entry process will be disqualified immediately.
12. In the event of a mobile phone being lost, stolen or damaged or a number being changed, the Promoter is unable to retrieve or transfer an existing entry to a new mobile number.
13. To the fullest extent permitted by applicable law, the Promoter and its agents assume no responsibility and are not liable for any person whose mobile phone is used to enter without the owner's permission. The bill payer is accepted as the entrant and should their mobile number be selected as a winner they will be the sole claimant of the prize.

The Prizes

14. There are 303 prizes in total to be won via prize draw, as follows:
    
    
    1. Break to Florence, Italy for 2 people (winner and 1 guest aged 18 or over) for 3 nights including travel and accomodation as specified further below. 3 to be won.
    2. £35 Pasta Evangelists Recipe Kit Gift Cards. 300 to be won.
15. Prizes cannot be transferred or exchanged nor (except where cash is specified) redeemed for cash. Without limiting any other of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement (except in accordance with clause 16).
16. The prizes are as stated and subject to availability. There are no cash or other prize alternatives available, except in the event of circumstances outside of the Promoter’s control, it reserves the right to award similar prizes of equal or greater value.
17. Maximum of 1 prize per person.

Winner Selection

18. 303 winners will be randomly selected from all valid entries using a verifiably random computer process on 22.07.2024. The Promoter’s decision is final and no correspondence will be entered into.

Break to Florence - Winner Notification

19. The winners will be contacted via the mobile phone number used to enter within 7 days of the draw date specified in clause 18 and will be required to respond to accept the prize, provide their receipt as proof of purchase, full name, email address and confirm eligibility. The Promoter will attempt to contact winners up to 3 times in a 14 day period of the original contact date. In the event that the Promoter is unable to contact a winner within this 14 day period, they are ineligible or reject the prize, the Promoter reserves the right to select an alternative winner from all remaining valid entries using the same process as detailed in clause 18, with the originally selected winner forfeiting their right to the prize. The process will repeat until an eligible winner is able to claim the prize. Entrants are encouraged to monitor their mobile phone during this time in case they are a winner.

Break to Florence - Prize Delivery and Additional Information

20. Upon confirmation of the winner’s eligibility, the winner’s details (name, mobile number and email address) will be passed onto our Travel Agent, Active Consultancy Ltd, and their fulfilment team will contact the winner within 28 days to arrange their prize by phone and / or email. Any personal data submitted by the winner to the Travel Agent will be treated in accordance with their Privacy Policy - Privacy Policy - Active Consultancy.
    
    
    1. The prize includes:
    1. Return economy flights from London Gatwick / Heathrow / Luton / Stansted, Manchester, Leeds, Bristol or Edinburgh to Florence with hand baggage only;
    2. Airport transfer (1 way only - Florence Airport (FLR) to Florence city centre);
    3. 1 night’s accommodation in a 4* hotel in Florence city centre on a B&B basis in a standard double / twin room;
    4. Pitti Taste 17 Tasting Menu at Golden View Restaurant, including £60 drinks allowance;
    5. 2 nights’ accommodation at Gabbiano Castle on a B&B basis in a standard twin / double room;
    6. 3 days car hire (economy 2 door car, pick-up Florence city centre, drop-off Florence Airport) including £100 petrol allowance. Car hire terms of relevant car hire provider will apply;
    7. £500 spending money;
    8. Travel insurance (see additional terms at clause 32).
22. The prize must be booked within 12 months of confirmation of winning.
23. The prize excludes travel over the Christmas and New Year period, Easter and bank holidays.
24. Both guests must be aged 18 and over at the time of travel.
25. Lead driver for car hire must be aged 21 or over, and carry a full clean UK driving license.
26. The holiday is subject to availability at the time of booking.
27. For the avoidance of doubt, any additional personal expenses such as room service, mini bar, drinks with meals, any other food, drink, treatments, activities, excursions, attractions, visas, personal expenses and/or anything else not expressly stated in these Terms and Conditions as being included as part of the prize will be sole responsibility of the winners and their guests.
28. £500 spending money and £100 petrol allowance to be paid by bank transfer to the winner’s nominated UK bank account no later than 14 days prior to the departure date. Winners will be required to provide their UK bank account details as required by the Travel Agent via a secure online form. Bank Account details will be deleted after 14 days from date provided.
29. The prize package must be taken as a whole, flights and hotels cannot be redeemed separately. The winners and their guests must travel together on the same flight to the prize destination and stay in the same hotel and room.
30. Winners and their guests must have a full valid passport. Any necessary visas are the responsibility of the winners and their guests.
31. It is the responsibility of the winners and their guests to ensure compliance with UK and Italian travel end entry requirements, including but not limited to any vaccination or testing requirements. 32. Travel insurance is subject to restrictions and the terms and conditions of the insurance provider. It is the responsibility of the winner and/or their guest to meet any additional costs relating to obtaining insurance cover for any pre-existing medical conditional and or any additional costs as may be specified where the winners and / or their guest are aged 70 or over.
33. A valid credit or debit card will be required for security deposit purposes when checking into hotel accommodation.
34. Once booked, the prize cannot be amended.
35. In the event that:
1. You are unable to travel due to:
1. Contracting COVID-19;
2. Being required to self-isolate pursuant to government guidelines;
3. Being resident in an area subject to government restrictions to combat the spread of COVID-19, out of which travel is not permitted; or
4. The fact the elected hotel is closed, or travel not permitted to its vicinity due to government restrictions to combat the spread of COVID-19, The Promoter may, if possible, arrange either an alternative hotel or and alternative date of stay as soon as possible after such circumstances are no longer applicable.
2. If this Promotion cannot run as planned for any reason beyond the Promoter’s control, and cannot be postponed without unreasonable or undue cost to the Promoter, for example due to COVID-19 lockdowns, shutdowns or other government restrictions, the Promoter may end, change, suspend or cancel the Promotion or disqualify affected entrants.
3. In the event of circumstances beyond its control the Promoter is not responsible for delays in a winner (if applicable) or their guests travel.

£35 Pasta Evangelists Recipe Kit eGift Cards – Winner Notification, Prize Delivery and Additional Information

36. Winners will receive a notification by text within 7 days of the prize draw to the mobile number used to enter the Promotion. To accept the prize winners are required to reply to 60163 with their first name and email address within 14 days of the initial notification. In providing your email address you agree for your email address to be provided to Pasta Evangelists in order to fulfil the prize. Prize winners may be contacted by the Promoter to provide a valid receipt as proof of purchase. In the event that the entrant does not respond to the text notification within the 14 day period, they are ineligible or reject the prize, the Promoter will select an alternative winner from all remaining valid entries using the same process as detailed in clause 18, with the originally selected winner forfeiting their right to the prize. The process will repeat until an eligible winner is able to claim the prize. It is the winner’s responsibility to ensure all personal information provided is correct. Entrants are encouraged to monitor their SMS messages during this time in case they are a winner.
37. Following receipt of the email address by the Promoter winners will receive an email from Totally Gifts to redeem for a Pasta Evangelists gift code within 30 days. Customers will have 12 months to redeem their Totally Gifts code for a Pasta Evangelists code, following the instructions in the email.
38. £35 Pasta Evangelists Receipt Kit Gift Card terms and conditions:
    1. Gift Cards must be redeemed on the Pasta Evangelists website - https://pastaevangelists.com as full or part payment for Recipe Kits;
    2. Gift Cards cannot be exchanged for cash. All Gift Cards are dated and are valid for 6 months from the date of issue;
    3. The Gift Card is only redeemable against Recipe Kit orders;
    4. When a Recipe Kit Gift Card is redeemed, the Gift Card will be converted into store credit on the customer's account, for redemption against any Recipe Kit order. Store credit expires 12 months from the date it is applied to an account.
    5. The first redemption of a Gift Card cannot be used in conjunction with any other credit or discount.
    6. Where products purchased online with a Gift Card are returned, any monies owing will be refunded as credit added to the Gift Card recipient's account at Pasta Evangelists.
    7. Pasta Evangelists is not responsible if a Gift Card is lost, stolen, destroyed or used without permission and no replacement will be provided in these circumstances.
    8. Any personal data you provide to us will be treated in accordance with our Privacy Policy - Privacy Policy | Pasta Evangelists.
39. Pasta Evangelists Ltd does not endorse this promotion nor the products of the Promoter, neither does the Promoter endorse Pasta Evangelists and is not an authorised distributer of their products.

General Terms and Conditions

40. The Promoter reserves the right to verify all entries and the winner(s) and to refuse to honour any entry or to recover the full value of any prize if it considers there has been an abuse or breach of the Terms and Conditions or any instructions forming part of the Promotion or otherwise where a participant has gained an unfair advantage in participating in the Promotion or won using fraudulent means.
41. In the event of a dispute over interpretation or implementation of the rules on any matter related to the Promotion, the decision of the directors of the Promoter is final and no correspondence will be entered into.
42. The Promoter cannot be held responsible for any technical issues, system or software failures encountered. The Promoter reserves the right to suspend temporarily the operation of the Promotion without notice in the case of system failure, maintenance or repair or for any other reason beyond its control. The Promoter does not warrant that its systems and its content are free from viruses or anything else that has contaminating or destructive properties. Internet software or transmission problems may produce inaccurate or incomplete copies of information and materials that may be downloaded and displayed onto your device. The Promoters will not be liable for any errors, changes, or omissions that occur during transmission of information and materials.

44. To the fullest extent permitted by law and excluding death or personal injury caused as a result of Promoter’s negligence, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
45. Owing to exceptional circumstances outside its reasonable control, the Promoter reserves the right to cancel or amend the Promotion or these Terms and Conditions at any stage but will always endeavour to minimise the effect to entrants in order to avoid undue disappointment.
46. This Promotion is not intended to promote overconsumption of alcohol. The Promoter encourages responsible drinking and directs consumers to visit www.drinkaware.co.uk for more information.
47. Instructions on instore promotional materials form part of the Terms and Conditions. Any breach of these Terms and Conditions will result in a forfeit of the prize.
48. Please note: All personal data collected as part of the Promotion will be handled by the Promoter in accordance with the Promoter’s privacy policy available at Privacy | Treasury Wine Estates (tweglobal.com).
49. These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the law of England and Wales. Any disputes arising out of or in connection with them or their subject matter or formation shall be subject to the exclusive jurisdiction of the English courts.
